We successfully represented a Sailor who was illegally separated from the Navy. Despite having more than 18 years of service, the Navy denied him reenlistment and discharged him without a separation proceeding. He had previously petitioned the Board for Correction of Naval Records (BCNR) without success. We filed a complaint in the Court of Federal Claims. The Government realized the strength of our argument and asked the Court to send the case back to the BCNR for a new review. This time, the BCNR acknowledged the illegal separation. Our client will now receive his military retirement and considerable back pay for the time between his separation and the date he should have reached 20 years of service.
